1. Seller information

2. Acceptance of terms

By accessing, registering for, or using the Service, you confirm that you are at least 18 years old (or the age of legal majority in your jurisdiction), that you have the authority to enter into these Terms on your own behalf or on behalf of your organization, and that you accept and agree to be bound by these Terms and our Privacy Policy.

3. About the Service

Alafiani Collective is a digital membership platform for African-centered reflection and community. Depending on your membership plan, features may include the Journal (a private journaling app with guided prompts), Circles (online community spaces), and Ayo (a reflective AI companion). The Service is a self-guided wellness and reflection tool. It is not therapy, counseling, medical care, or crisis intervention, and it does not create a clinical or therapeutic relationship. If you are in crisis, please contact a licensed professional or your local emergency services.

4. Your account and responsibilities

You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. You agree to provide accurate information and to keep it current. You must not:

• Use the Service for any unlawful purpose or in violation of applicable laws.
• Engage in fraud, spam, phishing, harassment, or impersonation.
• Infringe the intellectual property or other rights of any person or entity.
• Interfere with the Service's security, infrastructure, or other users' accounts, including through malware, scraping, probing, or automated abuse.
• Reverse engineer, circumvent, or resell access to the Service.

5. Your content

You retain ownership of content you create or upload (such as journal entries or Circle posts). By using the Service, you grant us a limited, non-exclusive license to host, process, display, and share that content solely as needed to provide, improve, and secure the Service. We may remove or restrict content that violates these Terms or that poses a safety, legal, or security risk.

6. Intellectual property

Stepsup LLC owns all rights, title, and interest in the Service, including software, designs, branding, documentation, and content we create. We grant you a limited, non-exclusive, non-transferable right to access and use the Service according to your membership plan and these Terms.

7. Free service

Alafiani Collective is currently provided free of charge. We do not collect payments or process subscriptions at this time. If we introduce paid features in the future, we will update these Terms and provide clear pricing and billing information before any charge is made.

8. AI features

Ayo and other AI features generate text based on your inputs. Outputs may be inaccurate, incomplete, or unsuitable for your situation, and are provided for reflection only. Do not rely on AI outputs for medical, psychological, legal, financial, or other professional advice. You are responsible for how you use the outputs and for any content you submit as input.

9. Service availability

We aim to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free performance. Maintenance, updates, third-party outages, or events beyond our control may affect availability.

10. Termination and suspension

We may suspend or terminate your access if you materially breach these Terms, fail to pay fees when due, create a security or fraud risk, or repeatedly or seriously violate our community standards. Upon termination, your access to paid features ends and we may delete or retain your data in accordance with our Privacy Policy.

11. Limitation of liability

To the fullest extent permitted by law, Stepsup LLC's aggregate liability for any claim arising out of or relating to the Service is limited to the total amount you paid us in the twelve (12) months preceding the event giving rise to liability. We are not liable for indirect, consequential, or special damages such as lost profits, data loss, or goodwill. Nothing in these Terms limits liability for fraud, death, or personal injury where required by law.

12. Indemnity

You agree to indemnify and hold harmless Stepsup LLC and its affiliates from claims arising out of your content, your use of the Service, or your violation of these Terms.

13. Governing law and disputes

These Terms are governed by the laws of the United States and the jurisdiction where Stepsup LLC is located, without regard to conflict-of-law rules. Any dispute arising from these Terms or the Service will be brought in the courts located in that jurisdiction.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will post the updated version in the Service and update the "Last updated" date. Your continued use of the Service after changes become effective means you accept the revised Terms.

15. Platform and shared responsibility

The Service is built on and hosted by Lovable Cloud, which provides underlying infrastructure such as database, authentication, and edge-function capabilities. Stepsup LLC is responsible for the app-level content, access controls, and data practices described in these Terms and our Privacy Policy. Lovable platform capabilities are described factually based on the features we have enabled, and are not a certification, audit, or guarantee of compliance.
